and Conditions
All
services provided by Pemba Diving Limited and associated companies,
Pemba Channel Lodge Limited and Pemba Channel Sea Safaris Limited
are governed by the laws of Kenya and any claims arising are subject
to these laws to the exclusion of all others.
Deposit
and Payment Terms
A
booking is confirmed and will be held once a deposit of 50% of
the quoted cost of the holiday has been received. The balance
is due and payable 30 days before departure.
Liability
Although
the M Y Kisiwani is maintained in good mechanical condition, breakdowns
can occur. Refunds will be made proportional to the number of
days not able to dive. The Company assumes no liability for the
for the acts or omissions of its employees, agents and suppliers
other than provided by the laws of Kenya and where air travel
is used, such liability is limited by the laws of Kenya and by
international convention. The Company accepts no liability for
the death, bodily injury or illness caused to client/s.
Cancellation
Refunds
will be made for cancellations made in writing 30 days prior to
the start of the holiday. A refund will be made for all monies
received minus a 5% administration fee of the quoted cost of the
holiday. Cancellations with less than 30 days notice will incur
forfeiture of the total quoted cost of the holiday.
Client
Responsibilities
Passports,
visas, health documents and any other documentation that is required
are the responsibility of the client and the Company can not be
held liable should the trip be affected in the absence of such
documents. It is recommended that the client purchase medical
and travel insurance as the client is not covered by any insurance
other than those provided for by the laws of Kenya.
